# GwG Art. 9a — Client orders concerning reported assets - **Rubric (DE):** Kundenaufträge betreffend die gemeldeten Vermögenswerte - **Rubric (EN):** Client orders concerning reported assets - **Status:** In force ## Description Article 9a governs how a financial intermediary handles client instructions concerning assets already covered by a report to MROS. Abs. 1 requires the intermediary to continue executing client orders relating to assets reported either under Art. 9 Abs. 1 Bst. a of this Act (the *Meldepflicht*) or under Art. 305ter Abs. 2 StGB (the *Melderecht*) while MROS conducts its analysis under Art. 23 Abs. 2 — a report does not automatically freeze the relationship. Abs. 2 adds a tracing safeguard: orders concerning significant assets may be executed only in a form that allows law-enforcement authorities to follow the trail. The provision sits between the reporting duty (Art. 9) and the intermediary's right to terminate the relationship once MROS's analysis window lapses (Art. 9b). ## Context & interpretation Art. 9a addresses the operational aftermath of a report. For reports under Art. 9 Abs. 1 Bst. a or Art. 305ter Abs. 2 StGB the intermediary keeps operating the relationship during MROS's analysis; a freeze follows only once MROS tells it that the report has been forwarded to a prosecution authority (Art. 10 Abs. 1). If MROS does not do so within 40 working days, the intermediary may terminate the relationship (Art. 9b). ## Serves AMLR - [[AMLR Art. 71 - Refraining from transactions|AMLR Art. 71]] — Refraining from transactions ## Swiss counterparts - [[GwG Art. 10 - Freezing of assets|GwG Art. 10]] — Under GwG Art. 9a client orders on reported assets are executed while MROS analyses the report; the freeze under GwG Art. 10 applies only once MROS passes the case to a prosecution authority.
