# GwG Art. 8d — Adviser organisational measures
- **Rubric (DE):** Organisatorische Massnahmen
- **Rubric (EN):** Adviser organisational measures; training and controls; covers EmbG sanctions breaches
- **Status:** In force
## Description
Article 8d, in force from 1 October 2026, requires advisers to take the organisational measures, within their own sphere, necessary to prevent money laundering and terrorist financing and to prevent breaches of sanctions-enforcement measures under the Embargo Act (EmbG, SR 946.231). The provision names two specific components: advisers must ensure adequate staff training and must maintain controls. It mirrors, for the new adviser category, the organisational-duty regime that already binds financial intermediaries, extending the internal-governance layer of Swiss AML law — training, controls, and now also sanctions compliance — to advisers for the first time.
## Context & interpretation
The express cross-reference to the Embargo Act is notable: it folds sanctions-circumvention risk into the adviser's AML compliance programme rather than leaving it to a separate function. Because advisers are a newly regulated gatekeeper class that typically lacks in-house compliance infrastructure — company-formation agents, domiciliary-address providers, real-estate transaction advisers — Art. 8d effectively obliges even small advisory practices to have training and control processes in place.

## Further AMLR connections
- [[AMLR Art. 12 - Awareness - training|AMLR Art. 12]] — AMLR Art. 12 requires awareness measures and ongoing, documented, function- and risk-appropriate staff training; GwG Art. 8d (in force 1.10.2026) requires the new adviser category to ensure adequate staff training and maintain controls. *(related)*
