# GwG Art. 8 — Organisational measures (training, internal controls)
- **Rubric (DE):** Organisatorische Massnahmen
- **Rubric (EN):** Organisational measures (training, internal controls)
- **Status:** In force
## Description
Requires financial intermediaries to take, within their own sphere, the organisational measures necessary to prevent money laundering, terrorist financing and (since 1 October 2026) breaches of Embargo Act (EmbG) coercive measures, in particular by ensuring adequate staff training and controls. This is a broad, principle-based duty and does not itself prescribe specific control mechanics; those are set at ordinance level (GwV-FINMA).
## Context & interpretation
Art. 8 is the statutory anchor for organisational AML compliance in Switzerland, and findings of organisational deficiency under it frequently accompany findings of clarification or CDD failure elsewhere in the Act. In its October 2021 conclusion of proceedings on Credit Suisse's Mozambique loans, FINMA found that the bank had "seriously violated the organisational requirements" and its money laundering reporting obligations. Because Art. 8 sets only a principle, it is also the sectoral benchmark regulators and commentators point to when assessing whether "reasonable organisational measures" existed for purposes of corporate criminal liability under Art. 102 StGB.
