# GwG Art. 7 — Duty to keep records - **Rubric (DE):** Dokumentationspflicht - **Rubric (EN):** Duty to keep records - **Status:** In force ## Description Requires the financial intermediary to document transactions carried out and clarifications performed under the Act so thoroughly that a qualified third party (*fachkundige Dritte*) could form a reliable judgement on the transactions, the relationships, and the intermediary's compliance with the Act (Abs. 1). Abs. 1bis, added in the 19 March 2021 revision (in force 1 Jan. 2023), requires periodic review of these records for continued accuracy and updating as needed, with the frequency, scope, and manner of review scaled to the contracting party's risk. Abs. 2 requires records to be kept so that requests for information or seizure by criminal prosecution authorities can be met within a reasonable time. Abs. 3 sets the retention period: at least ten years after the relationship ends or the transaction is completed. ## Context & interpretation The ten-year retention duty is the evidentiary backbone of Swiss AML enforcement: it is what allows MROS, FINMA, and prosecutors to reconstruct a relationship's history long after the fact, and Abs. 2 exists precisely so intermediaries can respond to StPO production and seizure orders. The "*fachkundige Dritte*" standard is a recurring benchmark in Swiss AML practice — documentation must be reconstructible by an independent expert, not merely intelligible internally — and it underpins both audits and criminal investigations. Abs. 1bis requires the records to be reviewed periodically and updated, rather than left as a one-off exercise at onboarding. ## Serves AMLR - [[AMLR Art. 20 - CDD measures|AMLR Art. 20]] — CDD measures - [[AMLR Art. 77 - Record retention|AMLR Art. 77]] — Record retention - [[AMLR Art. 78 - Records to authorities|AMLR Art. 78]] — Records to authorities ## Further AMLR connections - [[AMLR Art. 21 - Inability to comply with CDD|AMLR Art. 21]] — GwG Art. 7 Abs. 1 requires records of the clarifications the Act demands, reviewable by experts, with periodic updating (Abs. 1bis); AMLR Art. 21(3) also requires records of decisions and their justifications. *(related)* - [[AMLR Art. 26 - Ongoing monitoring|AMLR Art. 26]] — GwG Art. 7 Abs. 1bis requires periodic risk-based review and updating of records; AMLR Art. 26(2) additionally sets maximum update intervals of 1 year (higher risk) and 5 years.
