# GwG Art. 6 — Special due diligence obligations (clarification, monitoring, risk) - **Rubric (DE):** Besondere Sorgfaltspflichten - **Rubric (EN):** Special due diligence obligations (clarification, monitoring, risk) - **Status:** In force ## Description Requires the financial intermediary to identify the nature and purpose of the relationship the contracting party seeks (Abs. 1); the scope of information gathered, the management level required to approve entering or continuing the relationship, and the frequency of controls all scale with the risk the contracting party represents. Abs. 2 requires clarification of the background and purpose of a transaction or relationship whenever: (a) it appears unusual and its lawfulness is not evident; (b) there are indications assets stem from a felony or a qualified tax offense (Art. 305bis Ziff. 1bis StGB), are subject to a criminal or terrorist organisation's power of disposal (Art. 260ter StGB), or serve terrorist financing (Art. 260quinquies Abs. 1 StGB); (c) the transaction or relationship carries an increased risk; or (d) contracting-party, beneficial-owner, or signatory data matches or closely resembles data forwarded under Art. 22a Abs. 2 or 3. Abs. 3 deems relationships with foreign PEPs and their associates (Art. 2a Abs. 2) always increased-risk; Abs. 4 deems relationships with domestic PEPs, PEPs of international organisations, and their associates increased-risk only in conjunction with one or more further risk criteria. ## Context & interpretation Art. 6 is the operative core of Switzerland's risk-based CDD regime — it is the provision that actually requires intermediaries to look behind a transaction rather than merely identify a counterparty. The Abs. 3/Abs. 4 split (automatic increased risk for foreign PEPs versus conditional increased risk for domestic and international-organisation PEPs) is a standard point of practical confusion and reflects the 2016 FATF-driven revision. In the 1MDB affair FINMA found that BSI had executed numerous large transactions with unclear purpose without clarifying obvious red flags, and ordered disgorgement of CHF 95 million (2016; reduced to CHF 70 million in 2020). ## Serves AMLR - [[AMLR Art. 19 - Application of CDD|AMLR Art. 19]] — Application of CDD - [[AMLR Art. 20 - CDD measures|AMLR Art. 20]] — CDD measures - [[AMLR Art. 25 - Purpose - nature of relationship|AMLR Art. 25]] — Purpose / nature of relationship - [[AMLR Art. 26 - Ongoing monitoring|AMLR Art. 26]] — Ongoing monitoring - [[AMLR Art. 34 - Scope of enhanced due diligence|AMLR Art. 34]] — Scope of enhanced due diligence ## Further AMLR connections - [[AMLR Art. 33 - Simplified due diligence|AMLR Art. 33]] — GwG Art. 6(1) scales the extent of purpose-and-nature information and the periodicity of controls to the customer's risk; AMLR Art. 33(1)(c)–(d) lets obliged entities reduce purpose-and-nature information and the frequency or degree of transaction scrutiny where risk is low, within listed conditions. *(related)* - [[AMLR Art. 42 - Politically exposed persons|AMLR Art. 42]] — GwG Art. 6 classifies PEP relationships as higher-risk (foreign always, others with a further criterion); AMLR Art. 42 prescribes three specific measures for every PEP. *(related)* - [[AMLR Art. 46 - PEP family - associates|AMLR Art. 46]] — GwG Art. 6 extends PEP higher-risk status to 'nahestehende Personen' as one concept; AMLR Art. 46 names family members and close associates separately and extends specific measures. *(related)* ## FATF - [[FATF R.10 - Customer due diligence|FATF R.10 — Customer due diligence]] — GwG Art. 6 Abs. 1 requires identifying the nature and purpose of the relationship, with scope and control frequency set by risk; Abs. 2 requires clarification of unusual or higher-risk cases. *(direct)* - [[FATF R.12 - Politically exposed persons|FATF R.12 — Politically exposed persons]] — GwG Art. 6 Abs. 3 makes relationships with foreign PEPs and persons close to them higher-risk in every case; Abs. 4 does so for domestic and international-organisation PEPs only together with further risk criteria.
