# GwG Art. 5 — Repetition of identification / re-establishing the beneficial owner
- **Rubric (DE):** Erneute Identifizierung oder Feststellung der wirtschaftlich berechtigten Person
- **Rubric (EN):** Repetition of identification / re-establishing the beneficial owner
- **Status:** In force
## Description
Article 5 requires identification of the contracting party (Art. 3) or determination of the beneficial owner (Art. 4) to be repeated where doubt arises about the contracting party's identity or about beneficial ownership during the course of the business relationship (Abs. 1). For redeemable (cash-value) insurance policies, insurance institutions must additionally re-establish the beneficial owner where, at the insured event or surrender, the person entitled to the benefit is not the person who was entitled when the contract was concluded (Abs. 2).
## Context & interpretation
Art. 5 operationalises ongoing due diligence rather than a one-off, point-of-entry check: it is the statutory trigger for repeating identification or beneficial-owner determination when doubt arises, and, for redeemable insurance, when the entitled person changes, and it works together with Art. 6's duty to clarify the economic background of a relationship whenever such doubts or red flags arise.
