# GwG Art. 35 — Processing of personal data by MROS - **Rubric (DE):** Bearbeitung durch die Meldestelle - **Rubric (EN):** Processing of personal data by MROS - **Status:** In force ## Description Article 35 governs MROS's own processing of personal data. Under Abs. 1, this processing follows the Federal Act of 7 October 1994 on Criminal Police Central Offices (Zentralstellengesetz, SR 360), while a private individual's right of access follows Art. 8 of the Federal Act of 13 June 2008 on Federal Police Information Systems (SR 361) — not the general DSG regime of Art. 33. Abs. 2 lists the authorities with which MROS may exchange information through an automated retrieval procedure (Abrufverfahren): FINMA, the ESBK, the intercantonal gaming authority (*interkantonale Behörde*), the Zentralamt, the Federal Office of Justice (as transparency-register authority), the EFD (as *Kontrollstelle* under the TJPG), SECO and criminal prosecution authorities (Bst. e–h, since 1 October 2026); Bst. i (cantonal supervisory authorities under Art. 22b) is not yet in force. ## Context & interpretation Article 35 removes MROS's data processing from the ordinary DSG track set out in Art. 33 and places it under the police-intelligence regime instead, reflecting that MROS is run by the Federal Office of Police (Art. 23 Abs. 1). The addition of the cantonal supervisory authorities to the retrieval-exchange list (Abs. 2 Bst. i) is tied to the cantonal supervision under Art. 22b GwG and, like it, is not yet in force. ## Serves AMLR _none_ ## Swiss counterparts - [[GwG Art. 35a - Verification (MROS checks a person|GwG Art. 35a]] — Both govern MROS's own information processing: Art. 35 sets the legal regime and the retrieval exchange with other authorities, Art. 35a MROS's retrieval checks in police, migration, criminal-record, state-security and mutual-assistance databases. *(direct)* - [[GwG Art. 33 - Principle (processing of personal data)|GwG Art. 33]] — GwG Art. 33 subjects personal-data processing under the GwG to the DSG; Art. 35 Abs. 1 places MROS's processing under the Central Offices Act instead. *(related)* ## FATF - [[FATF R.2 - National cooperation and coordination|FATF R.2 — National cooperation and coordination]] — R.2 requires mechanisms for the FIU, supervisors and law enforcement to exchange information domestically; GwG Art. 35 Abs. 2 lets MROS exchange information by retrieval procedure with FINMA, the ESBK, the intercantonal authority, the Central Office, the BJ, the EFD, SECO and prosecution authorities.
