# GwG Art. 34 — Databases and files connected with reports and information provided to MROS
- **Rubric (DE):** Datenbanken und Akten im Zusammenhang mit den Meldungen und den an die Meldestelle herausgegebenen Informationen
- **Rubric (EN):** Databases and files connected with reports and information provided to MROS
- **Status:** In force
## Description
Article 34 requires financial intermediaries — and, since 1 October 2026, also advisers (*Beraterinnen und Berater*) — to keep separate databases and files for all documents connected with a report under Art. 9 GwG, a voluntary report under Art. 305ter Abs. 2 StGB, or an inquiry from MROS under Art. 11a (Abs. 1). Data from these collections may be passed on only to FINMA, the ESBK, the intercantonal gaming authority, the Zentralamt, supervisory organisations, self-regulatory organisations, MROS, and criminal prosecution authorities (Abs. 2). A data subject's right of access under Art. 25 of the Federal Act on Data Protection of 25 September 2020 must be asserted against MROS rather than against the intermediary itself, per Art. 35 (Abs. 3). The data must be destroyed five years after the report was made (Abs. 4).
## Context & interpretation
The mandated separation of report-related files from ordinary client files protects the confidentiality of a suspicious activity report, including from the reported client, limiting tipping-off risk while MROS or law enforcement acts on it. Routing data-subject access requests to MROS rather than the intermediary (Abs. 3) follows the same logic: an intermediary disclosing to its own client whether it filed a report would defeat the report's purpose. The five-year destruction rule (Abs. 4) caps how long sensitive suspicion data may be retained once a report has run its course. Since 1 October 2026 the Art. 34 duty also covers advisers, as part of the 2025 GwG revision extending the Act to advisers.
