# GwG Art. 33 — Principle (processing of personal data) - **Rubric (DE):** Grundsatz - **Rubric (EN):** Principle (processing of personal data) - **Status:** In force ## Description Article 33 subjects all processing of personal data under the GwG to the Federal Act on Data Protection (Datenschutzgesetz, DSG) of 25 September 2020 (SR 235.1). The cross-reference was itself updated by Annex 1 of the revised DSG and took effect on 1 September 2023, the date the new DSG replaced the 1992 Act. The article lays down no substantive rules of its own; the DSG applies generally, subject to the more specific rules in Art. 34–35a GwG. ## Context & interpretation Article 33 is the opening clause of the GwG's data-protection chapter; Art. 34–35a that follow carve out AML-specific rules — separate report-related file-keeping (Art. 34), MROS's own processing regime under the Central Offices Act (Art. 35), and MROS's cross-checking powers (Art. 35a) — that sit on top of, and in places displace, the general DSG baseline this article sets. ## Serves AMLR - [[AMLR Art. 76 - Processing of personal data|AMLR Art. 76]] — Processing of personal data ## Swiss counterparts - [[GwG Art. 35 - Processing of personal data by|GwG Art. 35]] — GwG Art. 33 subjects personal-data processing under the GwG to the DSG; Art. 35 Abs. 1 places MROS's processing under the Central Offices Act instead.
