# GwG Art. 3 — Verification of the identity of the customer
- **Rubric (DE):** Identifizierung der Vertragspartei
- **Rubric (EN):** Verification of the identity of the customer
- **Status:** In force
## Description
Article 3 requires the financial intermediary to identify the contracting party (*Vertragspartei*) on the basis of a probative document (*beweiskräftiges Dokument*, e.g. a passport or comparable ID) when entering into a business relationship (Abs. 1); where the contracting party is a legal person, the intermediary must also take note of its signing/authorisation rules and verify the identity of the individuals establishing the relationship on its behalf. Abs. 2 confines the identification duty in one-off cash transactions (*Kassageschäfte*) with a not-yet-identified party to cases where one or more apparently linked transactions reach a "significant value"; Abs. 3 applies an equivalent significant-value threshold to insurance premiums. Abs. 4 overrides both thresholds wherever there are indications of possible money laundering or terrorist financing. Abs. 5 delegates fixing the applicable significant-value thresholds to FINMA, the Federal Gaming Board (ESBK), the FDJP, the Federal Office for Customs and Border Security (BAZG) and the SROs, each for its own sector.
## Context & interpretation
Art. 3 is the foundational identification duty and, in bank practice, is implemented through the passport/certified-copy standards of the Swiss Bankers Association's CDD Agreement (VSB); it is deliberately narrower than Art. 4 — it establishes who the direct counterparty is, not who stands behind it economically, which is why Art. 4's beneficial-owner duty and the *Formular A* declaration exist as a separate, additional layer. The de-minimis carve-out in Abs. 2–3 (identification only required above a "significant value") is the statutory basis for the *Bagatellfälle* thresholds each supervisor sets in its own ordinance or self-regulation, subject always to the Abs. 4 override for suspicious cases regardless of amount.

> 4 Liegen in Fällen nach den Absätzen 2 und 3 Verdachtsmomente für mögliche Geldwäscherei oder Terrorismusfinanzierung vor, so ist die Identifizierung auch dann vorzunehmen, wenn die massgeblichen Beträge nicht erreicht werden.
