# GwG Art. 2b — Material coordination where an activity is both financial intermediation and advice
- **Rubric (DE):** Materiellrechtliche Koordination
- **Rubric (EN):** Material coordination where an activity is both financial intermediation and advice
- **Status:** In force
## Description
New provision, in force 1 October 2026, resolving overlap between the financial-intermediary and adviser regimes. Abs. 1 provides that where the same activity qualifies as both financial intermediation and advice under Art. 2 Abs. 3bis or 3ter, the rules applicable to financial intermediaries govern that activity. Abs. 2 addresses persons who act in both capacities: each activity remains subject to its own applicable rules, but such a person may elect to subject their entire activity to the financial-intermediary regime instead, with the Federal Council regulating the details of that election. The amending act separately inserts the section heading "1b. Abschnitt: Sorgfaltspflichten der Beraterinnen und Berater" after Art. 8a, ahead of Art. 8b–8d.
## Context & interpretation
Art. 2b prevents dual, potentially conflicting due-diligence regimes from applying to the same transaction: by default the financial-intermediary rules — the more established, FINMA/SRO-supervised standard — take precedence, while the election in Abs. 2 lets a firm with mixed activities opt into a single, uniform compliance framework rather than running parallel financial-intermediary and adviser programmes side by side.
