# GwG Art. 2a — Definitions (incl. politically exposed persons, beneficial owner) - **Rubric (DE):** Begriffe - **Rubric (EN):** Definitions (incl. politically exposed persons, beneficial owner) - **Status:** In force ## Description Article 2a defines the Act's central terms. Abs. 1 sets out three PEP categories: persons entrusted with prominent public functions abroad (Bst. a, foreign PEPs), the equivalent national-level functions in Switzerland (Bst. b, domestic PEPs, including board/management members of nationally significant state enterprises), and leading officials of intergovernmental organisations and international sports federations (Bst. c). Abs. 2 extends PEP treatment to natural persons recognisably close to a PEP through family, personal or business ties. Abs. 3 defines the beneficial owner of an operating legal entity as the natural person(s) who ultimately control it by holding, alone or in concert with third parties, at least 25% of its capital or voting rights, or by controlling it in some other way; failing identification, the senior-most member of the governing body must be established instead. Abs. 4 provides that domestic PEP status lapses 18 months after leaving office, without prejudice to intermediaries' general due-diligence duties. Abs. 5 defines "international sports federations" as the IOC and the non-state bodies it recognises to regulate one or more sports at global level. The article was inserted in 2014 to implement the 2012 revised FATF Recommendations, in force since 1 January 2016. ## Context & interpretation The 25% capital/voting threshold in Abs. 3 is the benchmark used throughout Swiss CDD practice (and mirrored in VSB 20 Art. 20, where control holders with 25% or more are recorded on *Formular K*). The three-tier PEP taxonomy — and the extension of PEP status to leading sports-federation officials — is a defining feature of Swiss AML practice, since Art. 2a determines when the enhanced due diligence of Art. 6 is triggered. From 1 October 2026, new Abs. 6 (added by the GwG-2026 revision) defines *nicht operative Rechtseinheiten* ("non-operating legal entities") — legal persons, companies, institutions, foundations, trusts, fiduciary companies and similar arrangements not formed or maintained to run or support an operating business or group, expressly including *Sitzgesellschaften* (domiciliary/shell companies) — the term used in the adviser scope of Art. 2 Abs. 3bis Bst. b–e. ## Serves AMLR - [[AMLR Art. 2 - Definitions|AMLR Art. 2]] — Definitions - [[AMLR Art. 3 - Obliged entities|AMLR Art. 3]] — Obliged entities - [[AMLR Art. 42 - Politically exposed persons|AMLR Art. 42]] — Politically exposed persons - [[AMLR Art. 46 - PEP family - associates|AMLR Art. 46]] — PEP family / associates ## Further AMLR connections - [[AMLR Art. 45 - Persons ceasing to be PEPs|AMLR Art. 45]] — Both address how long PEP treatment lasts after leaving office; AMLR Art. 45(2) sets a 12-month floor (longer while the risk persists) for all PEPs, whereas GwG Art. 2a(4) ends domestic-PEP status after 18 months with general due diligence reserved, and sets no end for foreign or international-organisation PEPs ("sind oder waren"). *(direct)* - [[AMLR Art. 51 - Identify BO of legal entities|AMLR Art. 51]] — Statutory BO definition for operating legal persons: at least 25% of capital or votes, alone or in concert, or control otherwise; senior governing-body member as fallback. *(direct)* - [[AMLR Art. 52 - BO through ownership interest|AMLR Art. 52]] — Same 25% threshold, expressed as capital or votes, direct or indirect and alone or in concert with third parties (the "in concert" wording is Swiss only), in the statutory definition of the beneficial owner of an operating legal person. The GwG has no indirect-chain calculation rule. *(direct)* - [[AMLR Art. 53 - BO through control|AMLR Art. 53]] — Statute names control in another way as an alternative route to beneficial-owner status, without defining it. Art. 53(2)-(4) define control and give examples. *(related)* ## FATF - [[FATF R.12 - Politically exposed persons|FATF R.12 — Politically exposed persons]] — GwG Art. 2a Abs. 1 defines foreign PEPs, domestic PEPs and PEPs of intergovernmental organisations and international sports federations; Abs. 2 covers persons close to them. *(direct)* ## Authoritative text > [!quote]- GwG Art. 2a — German original, SR 955.0, consolidated version of 1 October 2026 (Fedlex) > **Art. 2a Begriffe** > 1 Als politisch exponierte Person im Sinne dieses Gesetzes gelten: > a.
