# GwG Art. 29 — Information exchange among (domestic) authorities
- **Rubric (DE):** Informationsaustausch unter Behörden
- **Rubric (EN):** Information exchange among (domestic) authorities
- **Status:** In force
## Description
Article 29 governs information exchange among the domestic AML authorities. Abs. 1 lets FINMA, the ESBK, the intercantonal gaming authority, the Central Office, the BJ (transparency register), the EFD (TJPG control office), and MROS exchange all information and documents they need to apply the GwG and to combat money laundering, its predicate offences, organised crime and terrorism financing; the addition of the cantonal supervisory authorities under Art. 22b (Bst. h) is not yet in force. Abs. 1bis lets MROS and SECO exchange what they need to apply the GwG and the EmbG. Abs. 2 obliges federal, cantonal and communal authorities to transmit to MROS or the federal criminal police central offices, on request, all data needed for analysis to combat money laundering, its predicate offences, organised crime or terrorism financing, including financial information and specially protected personal data from pending criminal, administrative-criminal or administrative proceedings. Abs. 2bis lets MROS share information with those Abs. 2 authorities case by case, for those purposes only (Art. 30 Abs. 2–5 applies by analogy); Abs. 2ter requires a foreign reporting office's express consent before MROS relays its information onward. Abs. 3 has MROS inform FINMA, the ESBK, the intercantonal authority, and the Central Office of cantonal prosecutors' decisions; the amended Abs. 3 adding the Art. 22b cantonal authorities is not yet in force.
## Context & interpretation
Art. 29 is the backbone domestic-cooperation gateway of the Swiss AML architecture: inserted with effect from 1 February 2009 to implement FATF's revised recommendations, and broadened in 2016 (Abs. 2 revised; Abs. 2bis and 2ter inserted) and revised again in 2023 (Abs. 1, 2ter and 3). It sits alongside — and is functionally distinct from — [[GwG Art. 29b - Information exchange with MROS|Art. 29b]] (MROS exchange with AOs/SROs) and Art. 30 (MROS cooperation with foreign reporting offices), together defining concentric, purpose-limited circles of domestic, quasi-public and foreign information sharing.
## Serves AMLR
_none_
## Swiss counterparts
- [[TJPG Art. 42 - Administrative assistance between register authority|TJPG Art. 42]] — Both provide for information exchange between authorities: GwG Art. 29 Abs. 1 includes the BJ (register authority) and the EFD (Kontrollstelle) among the GwG authorities; TJPG Art. 42 Abs. 2 lets the competent federal authorities exchange what they need under the TJPG or the AML legislation. *(related)*
