# GwG Art. 22b — Cantonal supervision of public-law notaries (*Urkundspersonen*) - **Rubric (EN):** Cantonal supervision of public-law notaries acting as advisers; supervisor reports to MROS - **Status:** Not yet in force (adopted 26 September 2025; excluded from the 1 October 2026 entry into force, date to be set by the Federal Council — AS 2026 322) ## Description Article 22b (adopted 26 September 2025, not yet in force) provides for cantonal supervision of the advisers under Art. 2 Abs. 3quater, i.e. notaries employed under public law who, in that role, take part in financial transactions for third parties linked to the legal acts in Art. 2 Abs. 3bis Bst. a–e (buying and selling land; forming, running and selling non-operating legal entities). Abs. 1 derogates from the ordinary FINMA/AO/SRO supervisory chapter: each canton must designate the authority responsible for overseeing these notaries' compliance with the Chapter 2 due-diligence duties. Abs. 2 obliges that cantonal authority, where an adviser has not complied with the reporting duty, to report immediately to MROS if, in the course of supervision, it learns of facts giving reasonable grounds to suspect (*begründeter Verdacht*) an offence under Art. 260ter, 305bis or 305ter Abs. 1 StGB, assets from a felony or a qualified tax offence (Art. 305bis Ziff. 1bis StGB), assets controlled by a criminal or terrorist organisation, or assets serving terrorism financing (Art. 260quinquies Abs. 1 StGB) — mirroring the notary's own reporting duty. Abs. 3 has the cantonal authority specify the adviser due-diligence duties (Chapter 2, section 1b); its directives must be brought to the EFD's attention. ## Context & interpretation Art. 22b places supervision of these notaries with a cantonal authority instead of an SRO (compare Art. 12 Bst. d). ## Serves AMLR - [[AMLR Art. 70 - Specific-entity reporting|AMLR Art. 70]] — Specific-entity reporting ## Authoritative text > [!quote]- GwG Art. 22b — Änderung vom 26.
