# GwG Art. 22a — EFD forwards data on terrorist lists - **Rubric (EN):** EFD forwards data on terrorist lists to FINMA/ESBK - **Status:** In force ## Description Requires the Federal Department of Finance (EFD) to forward to FINMA, the ESBK, the intercantonal gaming authority and the Central Office data it receives from another state, and that state has published, on persons or organisations that state has itself listed under UN Security Council Resolution 1373 (2001) for terrorist activity or support of it (Abs. 1). FINMA passes the data on to the financial intermediaries it directly supervises (Art. 2 Abs. 2 Bst. a and b–dquater), to the supervisory organisations for intermediaries under Art. 2 Abs. 2 Bst. abis, and to the SROs for their affiliated members (Abs. 2); the ESBK, intercantonal authority and Central Office forward it to the intermediaries they supervise under Art. 2 Abs. 2 Bst. e–g (Abs. 3). The EFD must withhold forwarding if, after consulting the FDFA, FDJP, DDPS and WBF, it must assume that human rights or rule-of-law principles would be violated (Abs. 4). Since 1 October 2026, under Abs. 2 Bst. c the SROs forward the data to all affiliated *persons*, not only financial intermediaries. The amended Abs. 1, which adds the cantonal supervisory authorities for advisers under Art. 22b, is not yet in force. ## Context & interpretation The article is a purely administrative data-conduit implementing the UN 1373 terrorist-listing regime domestically, passing other states' published terrorist lists on to the supervised intermediaries and SROs; the article itself sets no screening duty (see [[AMLR Art. 27 - UN-sanctioned customers|AMLR Art. 27]]). Abs. 4's human-rights safeguard is notable in an otherwise mechanical provision: Switzerland does not automatically relay a foreign terrorist designation if doing so would conflict with human rights or rule-of-law standards, requiring inter-departmental consultation first.
