# GwG Art. 14 — Affiliation to a self-regulatory organisation - **Rubric (DE):** Anschluss an eine Selbstregulierungsorganisation - **Rubric (EN):** Affiliation to a self-regulatory organisation - **Status:** In force ## Description Requires financial intermediaries under Art. 2 Abs. 3 — those without a prudential licence, supervised via the SRO route rather than directly by FINMA — to affiliate with a self-regulatory organisation (SRO) (Abs. 1). Abs. 2 gives such an intermediary an enforceable right (*Anspruch*) to admission to an SRO if it: (a) ensures compliance with GwG duties through its internal rules and operational organisation; (b) enjoys a good reputation and offers a guarantee of compliance; (c) has management/administration personnel who also meet that reputational standard; and (d) has qualified participants of good repute whose influence will not harm prudent and sound business conduct. Abs. 3 lets an SRO make affiliation conditional on activity in specified fields. From 1 October 2026 the affiliation duty and the right of admission extend to advisers on the same terms, and Abs. 3 gains a further sentence letting SROs impose additional affiliation conditions in their own regulations. ## Context & interpretation Because Art. 2 Abs. 3 intermediaries have no prudential regulator of their own, SRO affiliation is what actually subjects them to AML supervision at all — refusal or loss of SRO membership effectively bars an intermediary from lawfully operating in Switzerland, which is why Abs. 2 casts admission as a qualified right rather than the SRO's unfettered discretion. Extending the same affiliation duty to advisers from 2026 is the practical mechanism by which the newly regulated advisory sector is brought under supervision, mirroring the model already applied to fiduciaries and other Art. 2 Abs. 3 intermediaries. ## Serves AMLR _none_ ## Swiss counterparts - [[GwG Art. 12 - Competence (supervision)|GwG Art. 12]] — GwG Art. 12 Bst. c and d place financial intermediaries under Art. 2 Abs. 3 and advisers under the supervision of recognised SROs; Art. 14 obliges them to join one. *(direct)* ## FATF - [[FATF R.26 - Regulation and supervision of financial institutions|FATF R.26 — Regulation and supervision of financial institutions]] — R.26 requires financial institutions to be licensed or registered and supervised, and criminals kept from controlling or managing them; GwG Art. 14 brings Art. 2 Abs. 3 intermediaries under supervision through compulsory SRO membership, conditional on the good reputation and proper conduct of the firm, its managers and qualified shareholders (Abs. 2). *(related)* - [[FATF R.28 - Regulation and supervision of DNFBPs|FATF R.28 — Regulation and supervision of DNFBPs]] — R.28(b) allows DNFBPs to be monitored by a self-regulatory body that also screens owners and managers; GwG Art. 14 requires advisers to join an SRO, conditional on the good reputation and proper conduct of the adviser, its managers and qualified shareholders (Abs. 2).
