# GwG Art. 12a — Coordination of supervision
- **Rubric (DE):** Koordination der Aufsicht
- **Rubric (EN):** Coordination of supervision
- **Status:** In force
## Description
New provision (in force 1 October 2026) preventing dual supervision where the same person is simultaneously a financial intermediary and an adviser. Abs. 1: a person subject as a financial intermediary under Art. 2 Abs. 2 to a sector-specific supervisory authority (e.g. FINMA) who also carries on advisory activity is supervised for all of its activities by that same authority. Abs. 2: a person affiliated to a recognised SRO because of financial-intermediation activity under Art. 2 Abs. 3 who also advises is supervised for all activities by that SRO. Abs. 3: financial intermediaries under Art. 2 Abs. 2 Bst. abis supervised by a supervisory organisation (*Aufsichtsorganisation*) under Art. 43a FINMAG are, for all their activities, supervised by that same organisation. The effect is a single-supervisor rule: whichever regime already captures the person as a financial intermediary also captures their advisory activity.
## Context & interpretation
Art. 12a is a direct consequence of the 2025 revision creating the adviser category and giving it its own supervisory perimeter under Art. 12 Bst. d. Without this coordination rule, a dual-hatted person — for example a licensed asset manager who also provides advisory services — could in principle answer to two different supervisors for the two sides of the same practice. Art. 12a collapses that into a single competent supervisor per person.
## Serves AMLR

## Swiss counterparts
- [[GwG Art. 12 - Competence (supervision)|GwG Art. 12]] — GwG Art. 12a adjusts the allocation of supervision in Art. 12 for persons who are both financial intermediaries and advisers: one supervisor (the special-law authority, the SRO, or the supervisory organisation under Art. 43a FINMAG) covers all their activities. *(direct)*
- [[GwG Art. 2b - Material coordination where an activity|GwG Art. 2b]] — GwG Art. 2b coordinates which duties apply where a person is both financial intermediary and adviser; Art. 12a coordinates who supervises such persons. *(related)*
