# GwG Art. 12 — Competence (supervision) - **Rubric (DE):** Zuständigkeit - **Rubric (EN):** Competence (supervision) - **Status:** In force ## Description Allocates supervisory competence for the Chapter 2 (customer due-diligence) duties across five bodies, tracking the intermediary category in Art. 2. FINMA supervises prudentially regulated intermediaries under Art. 2 Abs. 2 Bst. a–dquater; the ESBK (Federal Gaming Board) supervises those under Bst. e; the intercantonal supervisory and enforcement authority under Art. 105 BGS covers Bst. f; the *Zentralamt für Edelmetallkontrolle* covers Bst. g; and intermediaries under Art. 2 Abs. 3 (those without a prudential licence) are supervised by a recognised self-regulatory organisation (SRO) under Art. 24. From 1 October 2026 a new Bst. d adds advisers (*Beraterinnen und Berater*) to the list, placing them under SRO supervision on the same footing as Art. 2 Abs. 3 intermediaries. ## Context & interpretation Art. 12 is the anchor provision of Switzerland's dual-track AML supervisory model: prudential regulators (FINMA, the ESBK, the intercantonal gaming authority, the precious-metals *Zentralamt*) for licensed sectors, alongside a network of privately-run SROs (Art. 24 et seq.) for intermediaries — such as fiduciaries — that have no dedicated state regulator. Routing advisers to SRO supervision from 2026, rather than creating a new state authority, extends this established SRO model to the newly regulated advisory perimeter and keeps FINMA's direct oversight confined to prudentially licensed entities. ## Serves AMLR _none_ ## FATF - [[FATF R.27 - Powers of supervisors|FATF R.27 — Powers of supervisors]] — GwG Art. 12 allocates supervision of the GwG duties (FINMA, ESBK, intercantonal authority, Central Office, SROs); R.27 concerns the powers supervisors must have (inspections, compelling information, sanctions). *(related)* - [[FATF R.28 - Regulation and supervision of DNFBPs|FATF R.28 — Regulation and supervision of DNFBPs]] — GwG Art. 12 assigns supervision of casinos to the ESBK, of large-scale games to the intercantonal authority and of advisers to SROs (Bst. b, bbis, d); R.28 requires casinos to be comprehensively supervised and other DNFBPs monitored by a supervisor or self-regulatory body. *(related)* ## Swiss counterparts - [[GwG Art. 12a - Coordination of supervision where a|GwG Art. 12a]] — GwG Art. 12a adjusts the allocation of supervision in Art. 12 for persons who are both financial intermediaries and advisers: one supervisor (the special-law authority, the SRO, or the supervisory organisation under Art. 43a FINMAG) covers all their activities. *(direct)* - [[GwG Art. 14 - Affiliation to a self-regulatory organisation|GwG Art. 14]] — GwG Art. 12 Bst. c and d place financial intermediaries under Art. 2 Abs. 3 and advisers under the supervision of recognised SROs; Art. 14 obliges them to join one. *(direct)* - [[GwG Art. 26a - Domestic group companies|GwG Art. 26a]] — For intermediaries under Art. 2 Abs. 3, supervised by SROs under GwG Art. 12 Bst. c, Art. 26a lets FINMA accept proof of compliance in the audit report of their prudentially supervised group.
