# AMLR Art. 86 — Committee procedure
- **Part of:** [[AMLR]]
- **FATF keying:** _none_
- **Swiss provisions:** _none_

## What it requires
AMLR Art. 86 establishes that the Commission is assisted by the Committee on the Prevention of Money Laundering and Terrorist Financing, constituted under Article 34 of Regulation (EU) 2023/1113, acting as a comitology committee within the meaning of Regulation (EU) No 182/2011. Where a provision refers to this paragraph, the examination procedure in Article 5 of Regulation 182/2011 governs the Commission's implementing acts.
## Swiss position
Switzerland has no comitology committee of Member State representatives scrutinising executive rule-making. Ordinances are instead developed by the Federal Council or the competent authority itself and typically pass through the Vernehmlassung (consultation procedure), a broader, non-binding stakeholder-input process open to cantons, parties and associations before a text is finalised.
## Key divergences
Comitology is a formalised committee of Member State delegates that votes on Commission implementing acts under a fixed procedure; consultation is a non-voting input process run by the drafting authority itself, with no equivalent EU-style examination or vote and no committee institution standing between the executive and the enacted text. The two mechanisms serve different functions - EU comitology checks a supranational executive's exercise of delegated implementing power; Swiss consultation gathers stakeholder views before a domestic ordinance or bill is finalised - and are not otherwise comparable.
