# AMLR Art. 82 — Requests to EPPO > AMLR Art. 82 applies from 10 July 2027, alongside the rest of the AMLR. See [[Effective-dates timeline]]. - **Part of:** [[AMLR]] - **FATF keying:** [[FATF R.2 - National cooperation and coordination|FATF R.2]], [[FATF R.29 - Financial intelligence units|FATF R.29]] - **Swiss provisions:** _none_ - **Detailed citation:** - ## What it requires AMLR Art. 82(1) requires the EPPO to respond without undue delay to reasoned FIU requests for information needed for the FIU's functions under Chapter III of Directive (EU) 2024/1640. Art. 82(2) lets the EPPO postpone or refuse to provide the information where doing so would likely prejudice an ongoing investigation's proper conduct or confidentiality, but requires the EPPO to communicate any postponement or refusal, with reasons, to the requesting FIU in a timely manner. ## Swiss position Switzerland has no EPPO membership and no counterpart body under an obligation to answer FIU information requests in this way. MROS's cooperation channels are different: GwG Art. 30 lets MROS pass information to a foreign FIU that meets stated safeguards, and GwG Art. 32 governs MROS's cooperation with foreign criminal-prosecution authorities. Neither imposes a reciprocal duty on an EU or Union body to respond to MROS. No Swiss provision is mapped to this article. ## Key divergences As with Art. 81, this is a structural non-equivalence: the EPPO exists only within the EU legal order under Regulation (EU) 2017/1939, and Switzerland, outside the EU, has no institution performing that role or bound by a reciprocal duty to answer MROS. The FATF-keying correction to R.2/R.29 applies here for the same reason as Art. 81 - R.40 is built for cooperation between foreign counterpart FIUs, whereas the EPPO is a Union prosecutorial body, not a foreign counterpart FIU. Art. 82(2)'s postponement/refusal mechanism, tied to protecting an ongoing investigation, has no Swiss-side equivalent recorded here because there is no Swiss obligation for this article to attach a refusal ground to in the first place. ## Effective dates AMLR Art. 82 applies from 10 July 2027, alongside the rest of the AMLR.
