# AMLR Art. 62 — Beneficial ownership information > TJPG Art. 7 and Art. 8 have been in force since 1 October 2026. See [[Effective-dates timeline]]. GwG Art. 4 is already in force under the current consolidation. - **Part of:** [[AMLR]] - **FATF keying:** [[FATF R.24 - Transparency and beneficial ownership of legal persons|FATF R.24]] - **Swiss provisions:** [[GwG Art. 4 - Establishing the beneficial owner|GwG Art. 4]], [[TJPG Art. 7 - Duty to identify and verify|TJPG Art. 7]], [[TJPG Art. 8 - Documentation, keeping current, retention|TJPG Art. 8]] - **Detailed citation:** TJPG Art. 7 (identify + verify), Art. 8 (document, keep current, retain); GwG Art. 4 ## What it requires Legal entities and trustees must ensure the beneficial-ownership information they hold, give to obliged entities for due diligence, or submit to central registers stays adequate, accurate and up to date, covering identity, the nature and extent of the beneficial interest, and ownership-structure details (Art. 62(1)(a)-(f)). They must obtain that information within 28 calendar days of the entity's creation or the arrangement's setting up, update it within 28 days of any change, and update it at least annually (Art. 62(2)). ## Swiss position TJPG Art. 7 requires the company to identify its beneficial owners and gather name, date of birth, nationality, address/state of residence and information on the nature and extent of control exercised (Abs. 1), and to verify identity and beneficial-owner status with due care, demanding supporting documents from shareholders, beneficial owners or third parties (Abs. 2). TJPG Art. 8 requires documenting that information and keeping it current and accessible from within Switzerland at all times (Abs. 1); documenting any failed identification or verification attempt (Abs. 2); retaining the information and evidence for 10 years after a person ceases to be a beneficial owner (Abs. 3); and giving the OR Art. 718 Abs. 4 / 814 Abs. 3 person access to the documented information at AGs and GmbHs (Abs. 4). GwG Art. 4 separately requires a financial intermediary to establish the beneficial owner of its own contracting party. ## Key divergences AMLR Art. 62(2) fixes explicit deadlines: 28 calendar days to obtain information after creation, 28 days to update after any change, and at least annual updating. TJPG Art. 7-8 require the information to be kept current and accessible at all times but set no equivalent fixed-day deadline for initial collection or updates within these two articles (the register-reporting deadline itself sits in TJPG Art. 9, pinned separately to Art. 63). Retention also diverges structurally: TJPG Art. 8 Abs. 3 runs 10 years from when a person ceases to be beneficial owner, while AMLR Art. 63(6) keeps the para. 4 information (no beneficial owner identified) for 5 years after the entity's dissolution — different periods tied to different trigger events. AMLR Art. 62(1) lists beneficial-ownership data content across six detailed points, including class-of-beneficiary and multi-layered ownership-structure descriptions (points (c)-(f)); TJPG Art. 7 Abs. 1's list is shorter and contains no explicit multi-entity ownership-structure description requirement. ## Effective dates TJPG Art. 7 and Art. 8 have been in force since 1 October 2026.
