# AMLR Art. 5 — Exemptions for certain professional football clubs > AMLR Art. 3(3)(o) and the Art. 5 exemption apply from 10 July 2029, not 10 July 2027 with the rest of the Regulation (Art. 90). See [[Effective-dates timeline]]. - **Part of:** [[AMLR]] - **FATF keying:** _none_ - **Swiss provisions:** _none_ - **Detailed citation:** - ## What it requires AMLR Art. 5 lets Member States exempt, wholly or partly, top-division professional football clubs with total annual turnover under EUR 5,000,000 for each of the previous two calendar years, and lower-division clubs generally, from the Regulation's requirements on the basis of proven low risk. Exemption requires a documented risk assessment covering size and cross-border nature of transactions (Art. 5(2)) and risk-based monitoring to prevent abuse (Art. 5(3)). ## Swiss position Switzerland has no obliged-entity category for professional football clubs, so it has no exemption power to carve an exception out of either - not found in the Swiss texts reviewed. Swiss sports bodies are not GwG obliged entities; the closest Swiss link to sport in this concordance runs through the politically-exposed-person definition at GwG Art. 2a Abs. 1 Bst. c and Abs. 5, which treats senior officials of international sports federations - the IOC and the non-governmental organisations it recognises - as PEPs, not through any club-level obliged-entity or exemption regime. ## Key divergences AMLR Art. 3(3)(o) is an EU-specific extension of obliged-entity scope to professional football clubs, and Art. 5 is the paired exemption for smaller or lower-division clubs; it is not a FATF-designated non-financial-business category. Switzerland has no matching obliged-entity class to exempt from, so the comparison is one of absence rather than of differing exemption thresholds. Where Switzerland engages sport in AML terms at all, it does so through PEP status for sports-federation officials (GwG Art. 2a Abs. 1 Bst. c, Abs. 5) rather than through obligations on the clubs themselves - a different mechanism aimed at different persons for a different purpose, not a narrower or broader version of the same rule. AMLR Art. 3(3)(o) and the Art. 5 exemption power that goes with it do not even apply in the EU until 10 July 2029, two years after the rest of the Regulation (Art. 90) - see [[Effective-dates timeline]]. ## Effective dates AMLR Art. 3(3)(o) and the Art. 5 exemption apply from 10 July 2029, not 10 July 2027 with the rest of the Regulation (Art. 90).
