# AMLR Art. 41 — Residence-by-investment applicants > The AMLR applies from 10 July 2027. See [[Effective-dates timeline]]. - **Part of:** [[AMLR]] - **FATF keying:** [[FATF R.1 - Assessing risks and applying a risk-based approach|FATF R.1]] - **Swiss provisions:** _none_ - **Detailed citation:** - ## What it requires Where a customer is a third-country national applying for residence rights in a Member State in exchange for investment (transfer, property purchase/rental, government bonds, corporate investment, public-good donation, or state-budget contribution), obliged entities must apply, beyond Article 20 customer due diligence, at least the Article 34(4) points (a), (c), (e) and (f) enhanced measures: additional information on the customer/beneficial owners and on their source of funds and wealth; senior-management approval for establishing or continuing the relationship; and enhanced monitoring with increased control frequency and scrutiny of transaction patterns. ## Swiss position No Swiss provision is mapped to this article. Neither the GwG nor the GwV-FINMA contains a customer category defined by an application for residence rights in exchange for investment, and no residence or investment-migration concept appears in either instrument. ## Key divergences The AMLR creates a customer category defined by an immigration procedure and attaches a mandatory minimum package of enhanced due diligence to it, drawn from Art. 34(4) points (a), (c), (e) and (f). Points (a), (c), (e) and (f) are otherwise discretionary elements of the higher-risk toolkit under Art. 34(4); for residence-by-investment applicants they become compulsory, and they apply on top of the standard customer due diligence in Art. 20. Swiss anti-money-laundering law contains no equivalent trigger. A Swiss financial intermediary would reach such a customer only through the general higher-risk criteria it is required to develop for itself, not through a category defined by the customer's immigration status. There is accordingly no Swiss threshold, timing rule or measure to compare against the four AMLR measures. ## Effective dates The AMLR applies from 10 July 2027.
