## What it requires
AMLR Art. 30 empowers the Commission to identify, by delegated act adopted within 20 calendar days, third countries with compliance weaknesses in their national AML/CFT regimes - a lower threshold than Article 29's significant strategic deficiencies - taking as a baseline jurisdictions under increased monitoring by international standard-setters. The delegated act specifies which enhanced due diligence measures from the Article 34(4) list obliged entities must apply to mitigate risks from persons in that country, and the Commission reviews the list regularly to ensure the measures stay proportionate.
## Swiss position
Swiss law does not distinguish a lower-tier 'compliance weaknesses' category the way AMLR Art. 30 does. The same GwV-FINMA Art. 13 provision applies: Abs. 3 Bst. d makes relationships with persons resident in a country the FATF treats as 'High Risk' or non-cooperative, and calls for increased diligence toward, higher-risk per se regardless of role (Abs. 5); Abs. 2 Bst. a, b and g also list a FATF-listed country's seat, residence, nationality, business location or payment flow as risk criteria an intermediary weighs case by case under its own risk analysis (Abs. 2bis), without automatic high-risk status. There is no separate Swiss ordinance provision, delegated act or list keyed specifically to a FATF-style increased-monitoring listing distinct from the 'High Risk'/non-cooperative designation used for Art. 29.
## Key divergences
AMLR Art. 29 and Art. 30 create two tiers - significant strategic deficiencies and compliance weaknesses - each with its own Commission delegated act and its own set of tailored enhanced due diligence measures drawn from Article 34(4). GwV-FINMA Art. 13 does not replicate that two-tier structure: its single FATF-referenced per se trigger (Abs. 3 Bst. d) covers only countries for which the FATF calls for increased diligence and does not mention the FATF increased-monitoring list, and it assigns no country-specific measures the way the AMLR's per-country delegated acts do - the increased-diligence consequence under Swiss law is generic rather than tailored to the specific country. Switzerland again maintains no published list or delegated-act mechanism of its own for this node, relying on the FATF's own categorisation referenced directly in the ordinance text.
