# AMLR Art. 25 — Purpose / nature of relationship - **Part of:** [[AMLR]] - **FATF keying:** [[FATF R.10 - Customer due diligence|FATF R.10]] - **Swiss provisions:** [[GwG Art. 6 - Special due diligence obligations (clarification|GwG Art. 6]] - **Detailed citation:** GwG Art. 6 ## What it requires Before entering a business relationship or performing an occasional transaction, AMLR Art. 25 requires an obliged entity to satisfy itself that it understands the purpose and intended nature of that relationship or transaction, obtaining, where necessary, information on: the purpose and economic rationale (a); the estimated amount of envisaged activity (b); the source of funds (c); the destination of funds (d); and the customer's business activity or occupation (e). High-value-goods dealers under Art. 74 must also determine whether intended use is commercial or non-commercial. ## Swiss position GwG Art. 6 Abs. 1 requires the financial intermediary to identify the type and purpose of the business relationship the contracting party wants, scaling the scope of information gathered, the hierarchy level required to decide whether to enter or continue the relationship, and the periodicity of checks to the risk the contracting party presents. Abs. 2 goes further, requiring the intermediary to clarify the background and purpose of a transaction or relationship specifically where it appears unusual with no apparent lawful explanation, where there are indications of criminal or qualified-tax-offence proceeds or of a link to a criminal or terrorist organisation or terrorist financing, where the relationship carries increased risk, or where the parties' data matches a forwarded terrorism-list entry. ## Key divergences AMLR Art. 25 itemises five specific information categories to gather up front - economic rationale, estimated activity volume, source of funds, destination of funds, occupation - applicable generally 'where necessary'. GwG Art. 6 Abs. 1 states the duty more generally, as identifying 'type and purpose', with the depth of inquiry risk-scaled rather than fixed to named data points. GwG Art. 6 Abs. 2's background-and-purpose clarification duty is trigger-specific (unusual transaction, crime indicators, increased risk, terror-list data match) rather than a general pre-relationship requirement, so it reads as a narrower, suspicion-triggered supplement rather than a direct counterpart to AMLR Art. 25's baseline information-gathering duty. AMLR Art. 25's Art. 74 high-value-goods commercial/non-commercial purpose test has no identified Swiss counterpart. ## Further connections *These links come from an article-by-article comparison of the primary texts.
